Le contrat de ma\u00eetrise d&rsquo;\u0153uvre a \u00e9t\u00e9 r\u00e9sili\u00e9 en cours de chantier. Le ma\u00eetre d\u2019ouvrage a vendu son bien avant que les travaux ne soient achev\u00e9s. Le ma\u00eetre d\u2019ouvrage a assign\u00e9 le ma\u00eetre d\u2019\u0153uvre en r\u00e9paration.<\/p>\n<p><strong>Probl\u00e9matique<\/strong> : Est-ce que le juge peut se fonder exclusivement sur une expertise non judiciaire r\u00e9alis\u00e9e \u00e0 la demande de l&rsquo;une des parties en application des stipulations contractuelles\u00a0?<\/p>\n<p><strong>Consid\u00e9rant de principe\u00a0:<\/strong> \u00ab\u00a0<em>Si le juge ne peut fonder exclusivement sa d\u00e9cision sur un rapport d&rsquo;expertise non judiciaire, m\u00eame contradictoire, \u00e9tabli \u00e0 la demande d&rsquo;une partie, il en va diff\u00e9remment lorsque l&rsquo;expertise a \u00e9t\u00e9 diligent\u00e9e en application du contrat conclu par les parties par un expert choisi d&rsquo;un commun accord<\/em>.\u00a0\u00bb<\/p>\n<p><strong>Analyse\u00a0:<\/strong> La cour consid\u00e8re que les juges du fond pouvaient se prononcer exclusivement sur la base d\u2019une expertise non judicaire, sans d\u00e9naturer la valeur et la port\u00e9e des constatations port\u00e9es devant eux par une des parties, sous r\u00e9serve que cette expertise soit pr\u00e9vue par les stipulations contractuelles (i) et que l\u2019expert, conform\u00e9ment \u00e0 ces stipulations, ait \u00e9t\u00e9 choisi d\u2019un commun accord par les parties (ii).<\/p>\n<p>Attention donc \u00e0 l\u2019effet des clauses de r\u00e8glement des litiges ins\u00e9r\u00e9es contractuellement.<\/p>\n<p>Le suivi de l\u2019expertise ordonn\u00e9e sur un fondement contractuel devra \u00eatre tout aussi rigoureux qu\u2019une expertise judiciaire.<\/p>\n<p><strong>Expertises\u00a0:<\/strong> <em>Immobilier et construction<\/em><\/p>\n<p><em>Lien vers la <a href=\"https:\/\/www.courdecassation.fr\/decision\/695f68d4cdc6046d4798732a\">jurisprudence<\/a><\/em><\/p>\n<\/div><\/section><\/div><div  class='flex_column av-2urgio-712fcbfd75b52051be095c738f71eba0 av_one_fifth  avia-builder-el-3  el_after_av_three_fifth  avia-builder-el-last  flex_column_div  '     ><\/div><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Un ma\u00eetre d\u2019ouvrage a confi\u00e9 une mission de ma\u00eetrise d\u2019\u0153uvre \u00e0 une soci\u00e9t\u00e9 pour la reconstruction de deux logements.
